Who Is a Returning Resident?
A Returning Resident is a person who previously had settlement (indefinite permission to enter or stay) in the UK, which lapsed due to absence from the UK, and who now wishes to return to the UK for settlement.
When Does Settlement Lapse?
- General rule
- More than 2 years outside the UK
- Settlement under the EU Settlement Scheme (EUSS)
- More than 5 years
- Swiss nationals or qualifying family members with EUSS settlement
- More than 4 years
Exception: settlement does not lapse when accompanying a partner or parent who is a member of HM Forces or a Crown Servant.
Main Requirements
An applicant must normally:
- Be outside the UK.
- Have previously held settlement which has lapsed due to absence.
- Obtain entry clearance before arriving in the UK.
- Genuinely intend to return to the UK for settlement.
- Have maintained strong ties to the UK during the absence.
- Normally not have received public funds towards leaving the UK (Windrush exception).
- Meet suitability requirements and, where applicable, TB and parental consent requirements.
- Provide a passport or travel document, biometrics and the required fee.

Dependants
A Returning Resident cannot bring a partner or children as dependants on this route. Each person must qualify in their own right.
Decision & Grant
If all requirements are met, entry clearance for settlement is granted.
If the Application Is Refused
Administrative Review may be available.
